Employment is a contract between two parties, one being the employer and the other being the employee. An employee may be defined as: "A person in the service of another under any contract of hire, express or implied, oral or written, where the employer has the power or right to control and direct the employee in the material details of how the work is to be performed." Black's Law Dictionary page 471 (5th ed. 1979).

In a commercial setting, the employer conceives of a productive activity, generally with the intention of generating a profit, and the employee contributes labour to the enterprise, usually in return for payment of wages. Employment also exists in the public, non-profit and household sectors. To the extent that employment or the economic equivalent is not universal, unemployment exists.

What does an employee have to pay back if they were double paid?
Q. We learned that our payroll clerk paid herself an additional paycheck. We immediately terminated the employee of course. But since she already cashed the check and it's a new quarter, we can't void the check. My question is, is she only liable to pay back the net amount of money that she received? Is she responsible to pay back the employer taxes and workmans comp?

A. She would be liable for the entire portion of her pay she recieved. You would have to adjust your tax payments to the IRS. But, I would make her pay any administrative costs. You have leverage with herr.

A. P(Not employees and not spouses) = 1 - P(employees or spouses) (DeMorgan's law) = 1 - P(employees) - P(spoues) (See below for more about this.) = 1 - 1/2 - 1/3 = 1/6 = 16.67%. That is assuming that there is no overlap among the employees and their spouses. If there are employess whose spouse is also an employee than this doesn't work.
